SafeRise Technologies LLC (“we,” “us,” or “our”) owns and operates https://saferise.app/ and other websites, mobile applications, platforms, and services that link to these Terms of Use (individually, the “Site,” and collectively, the “Sites”). Through the Sites, SafeRise Technologies LLC provides various offerings, information, and resources related to the products, applications, and services available on our Sites (each a “Service” and collectively, the “Services”). References to the Sites include the Services.

SafeRise Technologies LLC may change, suspend, modify, or discontinue all or any part of the Sites or Services in its sole discretion with or without notice. SafeRise Technologies LLC is not liable if all or any part of a Site or Service is unavailable, interrupted, or delayed at any time or for any period. SafeRise Technologies LLC reserves the right to block, suspend, or deny access to any of the Sites or Services to any individual or entity at any time for any reason. SafeRise Technologies LLC is not obligated to correct, update, or maintain any information, content, or materials provided on the Sites.

GENERAL TERMS

These Terms of Use (together with any additional terms referenced herein) constitute a legally binding agreement between SafeRise Technologies LLC and the individuals that access or use the Sites or Services (or the parent or legal guardian of any such individuals under the age of eighteen (18)) (“users,” “you,” or “your”). These Terms of Use govern your access to and use of the Sites and Services.

Subject to your full and ongoing compliance with these Terms of Use, SafeRise Technologies LLC grants you a limited, revocable, non-exclusive, and non-transferable right to access and use the Sites and Services solely for their intended purposes.

If you access or use the Sites or Services on behalf of a business, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms of Use. In such case, the term “you” shall include both the entity and any individuals acting on its behalf.

By accessing or using the Sites or Services, you represent and warrant that you are of legal age to enter into a binding agreement with SafeRise Technologies LLC and that you agree to comply with these Terms of Use.

IF YOU ARE UNDER THE AGE OF EIGHTEEN (18) (A “MINOR”), YOUR PARENT OR LEGAL GUARDIAN MUST REVIEW AND CONSENT TO THESE TERMS OF USE BEFORE YOU MAY USE THE SITES OR SERVICES. BY PERMITTING A MINOR TO ACCESS OR USE THE SITES OR SERVICES, THE MINOR’S PARENT OR LEGAL GUARDIAN AGREES TO BE BOUND BY THESE TERMS OF USE AND ACCEPTS FULL RESPONSIBILITY FOR THE MINOR’S ACTIVITIES.

PLATFORMS AND SERVICES

SafeRise Technologies LLC may now or in the future provide multiple platforms and technologies (collectively, the “SafeRise Platforms”) that enable users to access and utilize the Services, including but not limited to mobile applications, web applications, messaging services, alert systems, and communication tools.

The Services are designed to allow users to share safety alerts, notifications, and information with trusted contacts selected by the user. These Services may include safety notifications, location-sharing alerts, check-in alerts, requests for assistance, invitations to join a Safety Circle, or other communications initiated by the user.

IMPORTANT SAFETY DISCLAIMER

The Services are provided solely as a communication and notification tool that allows users to notify trusted contacts regarding their safety status or location.

The Services are not an emergency response system and do not provide emergency services. SafeRise Technologies LLC does not monitor alerts, dispatch emergency responders, contact law enforcement, or provide emergency intervention.

Users should immediately contact local emergency services, including police, fire, or medical responders, in any situation requiring urgent or emergency assistance.

NO GUARANTEE OF MESSAGE DELIVERY

The Services may rely on telecommunications networks, mobile carrier infrastructure, internet connectivity, SMS messaging systems, and other third-party technologies to transmit alerts and notifications.

SafeRise Technologies LLC does not guarantee that any message, alert, notification, or communication transmitted through the Services will be delivered, received, read, or acted upon.

Messages or notifications may be delayed, blocked, misdirected, lost, or fail to be delivered due to circumstances beyond the control of SafeRise Technologies LLC, including but not limited to telecommunications failures, network outages, device configuration issues, mobile carrier limitations, international messaging restrictions, or third-party service interruptions.

Users acknowledge and agree that reliance solely upon the Services for personal safety is inappropriate and that users remain responsible for seeking appropriate emergency assistance when necessary.

USER RESPONSIBILITY

The Services allow users to select trusted contacts who may receive alerts or notifications when a user activates certain safety features.

SafeRise Technologies LLC does not verify, monitor, supervise, or guarantee the identity, availability, reliability, or responsiveness of any contact added to a user’s Safety Circle.

SafeRise Technologies LLC does not guarantee that any contact will receive, read, respond to, or provide assistance in response to any alert or notification.

Users remain solely responsible for their personal safety decisions, actions, and circumstances, including determining when to activate alerts and when to contact emergency services.

INTERNATIONAL USE

The Services may be accessed and used from multiple jurisdictions worldwide. Telecommunications systems, SMS delivery reliability, and location services may vary significantly across regions and countries.

SafeRise Technologies LLC does not guarantee the availability, reliability, or functionality of the Services in any particular jurisdiction or geographic location.

Users who access or use the Services outside of the United States acknowledge that they do so at their own risk and are responsible for compliance with all applicable local laws and regulations.

TECHNOLOGY LIMITATIONS

The operation and performance of the Services depend on numerous technological systems and factors beyond the control of SafeRise Technologies LLC, including but not limited to mobile devices, operating systems, GPS and location services, internet connectivity, network coverage, device battery levels, and third-party infrastructure.

Location information and alerts provided through the Services may be inaccurate, incomplete, delayed, or unavailable.

SafeRise Technologies LLC does not guarantee the accuracy, reliability, or timeliness of any location data or alerts transmitted through the Services.

LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, SafeRise Technologies LLC, its owners, officers, employees, affiliates, contractors, and partners shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or relating to the use of or inability to use the Sites or Services.

This limitation includes, without limitation, damages resulting from personal injury, loss of safety, delayed or failed message delivery, inaccurate location information, service interruptions, device malfunctions, telecommunications failures, third-party service disruptions, or any other circumstance related to the use of the Services.

USE OF SERVICES AT YOUR OWN RISK

The Sites and Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. SafeRise Technologies LLC disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, reliability of alerts or notifications, uninterrupted service, and error-free operation.

Users acknowledge that their use of the Sites and Services is entirely at their own risk.
